You must agree to our Terms and Conditions, listed below, before you can enter into a contract of sale with MovieTyme.com.
Please read them carefully, as they contain important clauses which explain MovieTyme.com's obligations and liabilities to you, which will alter your statutory rights.
In order to make a purchase from MovieTyme.com (this website) and to advise us of your agreement to these Terms and Conditions, you will have to check a box during the checkout process, you will then be directed to the next stage of the ordering process.
You will not be able to proceed /place an order until you do.
Please note: Unless stated otherwise standard DVD's on this site are Region 1 (USA Zoned), NTSC versions.
HD-DVD titles are NTSC, unless stated otherwise and may not work on PAL HD-DVD players.
Blu-ray titles, unless listed in our EU PS3 playable section, will only work on US Blu-ray machines.
All Nintendo Wii and some XBOX360 games will only play on a USA Console.
Refunds or replacements WILL NOT be issued due to incompatibility issues unless we have stated the incorrect region code of a Blu-ray listed title.
If you purchase a Blu-ray title that we have listed as Region Free and it turns out to be region locked you can return it for an exchange or full refund (inc return postage), even if opened.
Please note that the goods/point of sale at the time of placing orders (apart from our UK 1-2 section) is within the United States Of America.
All orders are shipped to the customer as soon as possible on an individual packaged basis from our USA offices.
ATTENTION: If you choose to cancel an order that has already been billed then the amount of that order/item will be applied to your account as store credit.
Please also note that discount coupons will NOT be refunded as credit. Once used, even if the order is canceled, the coupon will be lost.
Store credit that is used on an order that is canceled will be returned to your account as store credit, any balance you have paid via credit/debit cards can be returned to same credit/debit card if an item has to be canceled due to issues beyond the customers control (such as out of stock, deleted etc etc).
If we are unable to fulfill an order, or a refund has to be done through no fault of the customers, then the option to have the refund back to your credit card is offered.
We would advise all Customers to be sure they want what they are ordering.
Service Contract between you (the customer) and MovieTyme.com (this website):
By purchasing off this website you are asking for MovieTyme.com to act as your personal import agent for the purpose of arranging your purchase of goods from a supplier, collecting your payment and forwarding your payment for the goods to the supplier, and then receiving your goods from the supplier, as your agent and then arranging delivery of your goods from MovieTyme.com to you.
It is understood that MovieTyme.com will charge you a commission for carrying out this service which is incorporated into the price displayed on the website.
All suppliers have agreed that MovieTyme.com will act as their agent only for the purpose of receiving complaints, providing limited after-agreement services, and receiving notices and communications from you.
All orders placed for titles or goods currently released will be charged for straight away, only items not yet released will not be billed.
If you wish to cancel an order for a title that is already released and therefore billed to your card already we can only issue a credit voucher against a future purchase.
This also applies to UK 1-2 section orders that are covered under EU Distance Selling Regulations - that do not state that a refund has to be to the credit card billed. Refunds can be issued by way of credit for future purchases.
If a refund is to be done due to us being unable to supply a title etc then you have the option to have a refund back to your credit card or a credit voucher against a future purchase.
If an order has a status as processing or queued for process then we cannot cancel this order, although an item can be returned if unopened.
As we are selling Audio / Video recordings and computer software (inc games) by law we are under no obligation to accept a return if the goods have been unsealed.
If, as a gesture of good will, we choose to have a disc returned to us, a credit for the amount of the returned item will only be credited to your MovieTyme account and NOT back to the credit card used when placing the order.
Please note: All returns must be within 7 working days (not including weekends or bank holidays) after the day on which the goods were delivered.
If you have cancelled an order and wish to return it unopened then all mailing costs must be paid by you (the customer).
Please Note: MovieTyme reserve the right to refuse your custom if we have had prior issues or there is a possible risk of fraud to us, our affilliate's or our merchant service provider.
Some items if shipped to customers outside of the US may be subject to inspection and additional duties and taxes may become payable, these extra charges must be borne by you the customer.
If you require any further information with regards to these charges please contact your countries Customs agency.
Certain titles are shipped at the customers own risk, no refund shall be given for titles seized by Customs, it is up to you the customer to know the laws of your own country.
We cannot make any adjustment to your order once it has been invoiced and shipped.
When receiving goods from couriers please be sure to note any damage to outer packaging and reject the parcel/parcels if appropriate - Movietyme cannot be held responsible for replacement of damaged products which have been signed for and accepted.
IMPORTANT: When accepting packages you must ALWAYS write the words "contents not checked for damage" next to your signature, in the event of damage this will enable a claim to go forward. If you do not sign this way and a problem is later found then we are unable to assist with a claim.
Customers will require a suitable DVD player and TV to be able to play product off this site.
Once a DVD has been opened we cannot accept it back unless found and proved to be faulty.
If an item does arrive faulty please email us and we shall advise of the returns number and address to mail the faulty item back to us.
IMPORTANT: Please be sure to obtain a proof of posting when sending items back top us, just in case of loss. If you do not and the item goes missing on route back to us, no party will be able to file a claim for the loss.
Once the faulty item has been received by us and checked for errors we shall dispatch a replacement if required, if you do not require a replacement then we will issue a CREDIT ONLY TO YOUR ACCOUNT for a future purchase. No REFUND will be issued to your credit card.
We cannot specify if a title is cut or uncut.
Backorders & Pre Orders: Back orders will be dispatched immediately based on availability. Pre Orders will only be billed once they reach the official release date and/or we are preparing to ship these titles out, there are sometimes delays between billing and shipping on pre orders if we are "short shipped" the amounts required or if titles come from smaller distribution companies etc.
Lost Mail (UK Customers):
Depending on what type of shipping you chose when checking out depends on when you can advise us of the none arrival.
If you have chosen Standard UK Shipping then the average delivery time of this method is considered to be between 7 and 21 business days from the date of dispatch. After 21 business days if your item has failed to arrive please email us at help@movietyme.com to advise us of such. We shall then issue you with a Lost Mail Claim form to simply sign and return to us in the included envelope that is free of charge for you to return to us (UK customers only).
If you have chosen UK Express Shipping we can handle your claim quicker. Average delivery times for this method is 5 to 9 business days from the date of dispatch. If after 15 business days (this is the amount of time Royal Mail state we have to allow before claims can be made) your item has still not arrived please email us as per the email address above.
Please be aware the above are "average" delivery times and item(s) may arrive earlier or later than stated - obviously delivery times are beyond our control.

If you feel an item has gone missing this is the procedure that Royal Mail has told us we have to follow:
1) Please send us an email stating your order number and that you have allowed the alloted time as listed above for which ever shipping method you have selected at checkout.
2) We shall then reply and inform you that we are mailing you (as Royal Mail will at this time not allow us to email) a Royal Mail P91 Lost Mail Claim Form.
3) Once you have taken delivery of this claim form please complete it, sign it and return it in the pre paid envelope.
4) Once we have your completed claim form back we can either issue a credit to your MovieTyme account, or issue you with a direct replacement item for the one that was "lost".
Adult XXX Info (UK Only): For our UK customers: following a judgement by the court of appeal which led the British Board of Film Classification (BBFC) to publish new guidelines for its issue of R18 certificates. Customs will therefore no longer seize material depicting sexual activity between consenting adults which falls within the BBFC published guidelines. Sexual acts which are excluded from the BBFC criteria for R18 certification will continue to be considered obscene. This includes anal and vaginal fisting, urination, defecation, pseudo masochism and bondage. Customs will also maintain controls on material involving children or animals, and also material depicting rape, excessive violence or animal cruelty.
Returns: You have 30 days from receipt of the order to return any titles that are defective or damaged (from either manufacture or shipping) and we will replace it with the same title only.
If the return is due to a shipping error we will exchange it for the right merchandise or issue a refund.
Returns can only be accepted if the entire purchase is returned (this includes outer/inner packaging etc), unless the item is a box set in which case if only a disc is faulty we would ask you only return the faulty disc for exchange.
Please contact customer service before sending any orders back - if not then this will cause delays with dealing with your return.
We cannot exchange a DVD if it has been opened (unless defective), or is incompatible with your DVD player or TV system, is not deemed to be defective by the manufacturer, or simply because you do not like the content. Items received like this shall be returned forthwith.
Please ensure all details are correct before completing the checkout process.
Any items which are undelivered on route to you and need to be re-shipped shall incur additional postage costs billed to the customer. We regret that we are unable to refund any return shipping costs for mistakes that are not our fault.
Please note: We will only refund the mailing costs of shipping items back to us via first class only, any returned items sent using other postage methods (Recorded or Special) is undertaken at your own expense.
Any returns must be accompanied with a covering letter, with your full details and reason for the return, failure to do so will result in your replacement not being shipped as we have no proof where it came from.
Customers outside the U.K and Ireland must fax the front and back of their credit card along with a copy of a recent credit card statement showing the customers name and address, this is due to the amount of credit card fraud in the world today.
We cannot accept returns of opened product.
Putting a 'ship to' address in the comments section during the checkout process is not appropriate and will be ignored! The address you put in the cart under 'ship to' is the address goods will go to.
